Terms of service

Draft. These terms must be reviewed by a Cyprus-qualified lawyer before Memorium takes live orders.

1. What we do

We digitise physical media — videotape, cine film, photographs, audio and data — and deliver the result as digital files. Your original items are returned to you unless you have asked us in writing to do otherwise.

2. Prices and payment

Prices shown include VAT at 19% and the return of your originals. You pay before your items are sent to us, either in full or as a 50% deposit with the balance due on completion. Where you have paid a deposit, your files are released once the balance is settled.

3. If your items differ from what you told us

Your quote is based on what you declare and on the photograph you provide. If what arrives differs, we will contact you with a revised price and will not proceed until you approve it. We never charge more without asking. If you decline, we return your items and refund what you paid, less any work already carried out.

4. Right of withdrawal

For distance contracts you normally have 14 days to withdraw. Because digitisation begins as soon as your items reach us, you expressly consent at checkout to work starting immediately and acknowledge that your right of withdrawal ends once the service has been fully performed.

5. Condition of your media

Ageing media sometimes fails. Tape can snap, become mouldy, or shed its oxide layer on first playback; film can suffer vinegar syndrome. We take reasonable care but cannot guarantee that any given item will play or that its full content can be recovered. Where an item cannot be digitised we refund the charge for that item.

6. Our liability

Your items are irreplaceable and we treat them that way. However, our total liability for loss or damage is limited to the amount you paid for the service. We are not liable for the sentimental or commercial value of any recording. You are strongly advised to keep your own copy of anything already digitised.

7. Transport

You choose where to drop off your box. While it is in the courier’s hands it is subject to that courier’s terms and liability. Our responsibility begins when we collect your box and photograph its contents.

8. Your job code

Your job code is how we identify your order. Our suppliers never see your name or contact details. Please place the code inside the box — a box without one cannot be matched to you quickly.

9. Download period

Your files are available to download for the period stated on your order. We keep an archive copy for a further period and can usually re-issue a link on request. You remain responsible for keeping your own backup.

10. Unclaimed items

If your box does not reach us, or you do not settle a balance, we will contact you several times. Items left unclaimed for an extended period may be subject to a storage charge or disposal, and we will always write to you first.

11. Your data

We handle personal data as described in our privacy notice. The contents of your recordings are confidential and are shared only with the supplier digitising them, under a written data processing agreement.

12. Governing law

These terms are governed by the law of the Republic of Cyprus.
